Because Federal, State or County laws and regulations may prohibit removal or modification of components that were installed on vehicles by their manufacturer to meet motor vehicle safety regulations applicable to vehicles manufactured for use on public roads, Atlas Distribution Engineering recommends that vehicles which fall under these regulations and are equipped with parts designated “for off highway use” or “racing” not be operated on the public roads, and offers such parts only for track or off highway competitive or performance use only.  Performance parts may exceed the design limits of the vehicle and its sub-systems. Suitability and implementation of parts is at the sole discretion of the buyer.  Buyer agrees to operate the vehicle under the conditions set forth in this agreement and agrees to hold STMPO Race Products, its employees, officers and vendors harmless by reason of any claim, damages, accident or injuries resulting from the installation of the parts or the use of the vehicle with the installed parts.

STMPO Race Productsdoes not endorse modification of vehicles for use on public highways where warranty or government regulations may be violated.   As an express condition of sale of any performance part, buyer acknowledges and agrees to use the performance parts for the modification of vehicles in a manner consistent with any and all local and federal regulations and laws.  Emission related after market parts that modify the emission control system may not be legal for sale or use on pollution controlled vehicles. The entire risk as to quality and performance parts is assumed by the buyer.   In the event such parts prove defective following their purchase and installation, the buyer, and not STMPO Race Products assumes the entire cost of any necessary servicing, repair or replacement.

Pricing

STMPO Race Productscannot confirm the price of an item until after the item is ordered.   In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or product information, STMPO Race Productsshall have the right, at its sole discretion, to refuse or cancel any orders placed for that item. In the event that an item is mispriced, STMPO Race Products may, at its sole discretion, either contact buyer for instructions or cancel buyer’s order and notify buyer of such cancellation.   Prices and availability are subject to change without notice. STMPO Race Products shall not be responsible for information provided by third parties (i.e. product specifications, delivery dates, etc.)  

Order Acceptance

STMPO Race Productsreserves the right, at its sole discretion, to refuse or cancel any order for any reason.   Situations that may result in buyer’s order being canceled include but are not limited to limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit department. STMPO Race Productsmay also require additional verification or information before accepting any order.  

Product Warranty & Disclaimer

STMPO Race Products offers a one (1) year warranty against defects in workmanship or materials on products manufactured by or for STMPO Race Products.  Atlas Distribution Engineering offers no warranty on products manufactured by others other than the product warranty provided by the manufacturer. Warranty claims for items provided by other manufacturers will be handled by the terms of the manufacturer.  No warranty is provided on electrical components (i.e. air sensors, oxygen sensors, light bulbs, etc.) or wearable mechanical item (i.e. brake rotors, brake pads, clutch discs, clutch pressure plates, flywheels, etc.)   STMPO Race Productsproducts have been designed and are intended for off highway and/or racing applications only.   Installation of these products may void the warranty coverage, if any, on your vehicle.   Manufacturer of vehicle and parts warranties may be voided if the vehicle or part is used for competition or if they fail as a result of modification. STMPO Race Productsshall not be responsible should the manufacturer void its warranty by reason of installation of the part or any other modifications occasioned by the installation of said part. Buyer hereby releases and discharges STMPO Race Products, its employees, officers and all other persons and associations connected therewith from any and all claims arising out of, or relating to, the parts purchased.   Buyer acknowledges that there may be additional conditions of sale as set forth in the product sales literature of the respective manufacturers of products sold by STMPO Race Products. Any claims on items sold by, but not manufactured by STMPO Race Products, shall be made with the respective manufacturers.   Implied warranties, including warranties of merchantability or fitness for a particular purpose are excluded from any warranty provided by STMPO Race Products. In order to make any warranty claim, buyer must provide STMPO Race Products with a copy of buyer’s invoice as proof of purchase. Atlas Distribution Engineering will only replace or repair warranty items. No refunds will be given. STMPO Race Productsor the product manufacturer shall inspect and/or test all products prior to any decision to pay a warranty claim.   Simply returning the product to STMPO Race Products will not guarantee payment of a warranty claim.   STMPO Race Products shall not pay for consequential, incidental and/or contingent damages or costs incurred of any kind, including the cost incurred directly or indirectly in relation to products sold by STMPO Race Products. 

Do not use these products until you have carefully read the following agreement. This sets forth the terms and conditions for the use of this product. The installation of this product indicates that the BUYER has read and understands this agreement and accepts it terms and conditions.
Performance products by their nature are designed to increase horsepower and performance not engineered into the original vehicle and the increased stress could result in damage to related systems. This is a high performance product - use at your own risk.
STMPO Race Products , its agents, employees, or owners shall not be under any liability in contract or otherwise whether or not resulting from our negligence or contents of information supplied for any damage or loss resulting from such information.

The BUYER is responsible to fully understand the capability and limitations of his/her vehicle according to manufacturer specifications and agrees to hold the SELLER harmless from any damage resulting from failure to adhere to such specifications.

The SELLER disclaims any warranty and expressly disclaims any liability for personal injury or damages.

The BUYER acknowledges and agrees that the disclaimer of any liability for personal injury is a material term for this agreement and the BUYER agrees to indemnify the SELLER and to hold the SELLER harmless from any claim related to the item of the equipment purchased. Under no circumstances will the SELLER be liable for any damages or expenses by reason of use or sale of any such equipment.

The BUYER is responsible to obey all applicable federal, state, and local laws, statutes, and ordinances when operating his/her vehicle, and the BUYER agrees to hold the SELLER harmless from any violation hereof. The SELLER assumes no liability regarding the improper installation or misapplication of its products. It is the installer's responsibility to check for proper installation and if in doubt, contact the manufacturer.

Returns and Shipping

Within 10 days of receipt of a product, you may return a product ordered from our online store. Returned products must be in their original packaging with all instructions and warranty cards. All products must be complete and undamaged. Disassembled, damaged, used, or custom products cannot be returned. If the return is due to an error by STMPO Race Products , you will be credited for the return postage or freight; otherwise you are responsible for the return postage or freight. All returns are subject to a 20% restocking fee. No returns accepted on special orders. If you wish to return an item you must contact us prior to sending it out. Items shipped to us without prior authorization will be refused and returned to you at your expense. When a return is received it will be thoroughly inspected before any refund will be given. Should the item be deemed un returnable the item will be returned to the buyer at their expense.

If an item is returned by refusing the shipment, shipping costs on the return will be deducted from the amount returned to the customer.

Shipping is a fee paid to a third party provider for their service and is therefore non refundable. Shipping quotes generated by the website may not reflect actual cost. Actual shipping will be charged on each order. The customer will be notified of any discrepancy between website and actual.  

Items from our web store may be offered with free shipping. Free shipping means the cost of shipping is absorbed by the company not passed on to the customer. If an item listed as free shipping is returned to us the cost we paid for shipping is not refundable.

Items listed as free shipping only apply to the lower 48 states.

Payment

All payments must be received and cleared in full before any item will be shipped. Payment methods accepted include all major credit cards, PayPal, money orders, and personal checks. Personal checks will be accepted on the terms that a thirty day period is required to allow the check to clear. Paypal E-Checks must also clear before the product can be shipped. No refunds will be given on uncleared funds.
